BUILDING BOARD OF APPEALS
The International Building and Residential Codes provide for the establishment of an appellate body for reviewing and ruling on interpretations by the building official which are questioned by a project owner, designer, or contractor. In Summit County, this authority is called the Board of Appeals.
Requests for variance to a specific code requirement should first be submitted in writing to the Chief Building Official. The request should include a specific description of conditions that justify the requested variance, and alternate measures proposed to meet the intent of the specific requirement of the code.
If you are dissatisfied with the building official's ruling, your request may be submitted to the Board of Appeals. It should be noted, however, that the Board does not have authority to waive code requirements, but only has the authority to judge the reasonableness of the Chief Building Official's judgment and decision. These requests should again be in writing, addressed to the Board of Appeals, and be submitted to the Chief Building Official.
