The right of the landlord beyond receiving the rent for the property. The covenants give the landlord the right to declare the lease terminated is the tenant fails to pay his rent. A landlord can prohibit tenant from sub-leasing the premises by setting up the lease. If a tenant breaks this condition regarding subletting and the landlord accepts the rent with due knowledge of the broken condition, the landlord cannot remove the tenant. A landlord has the right to enter upon the premises for the purpose of inspecting where he believes waste has been committed, after giving notice to the tenant. A landlord need not make repairs unless he in expressedly covenanted to do so. But even if he has agreed to do so and does not, this does not excuse the tenant from paying his rent to the landlord.

DUTIES OF THE LANDLORD

The landlord has definite duties in relation to his tenant.

#1. TO GIVE HIS TENANT QUIET ENJOYMENT OF THE PREMISES. If the tenant pays his rent and abides by the other conditions of the lease, may “quietly and peaceably” have, hold, and enjoy the leased premises.

#2. TO ALLOW NO NUISANCES ON OR NEAR THE PREMISES. A nuisance is something with interferes with the use and enjoyment of the property. A nuisance might consist of a pot-hole, noise, odor, smoke AND the landlord is liable should these things emanate from his owned premises and thus be under his control.

#3. TO PAY THE TAXES. The landlord must pay the taxes, the ground rent, and the interest on a mortgage which may exist. His failure to do so does not make the tenant liable for such payments.

#4. TO MAKE REPAIRS, IF AGREED IN LEASE. The landlord is ordinarily bound to make repairs only when such covenant is included in the lease. Should extensive repairs become necessary to the structure of a building, state and city statutes require landlords to repair their property.
