			<content:encoded><![CDATA[<p>Senior Citizens moving into Summit County. The number if seniors living in Summit County is going to continue to skyrocket over the next couple of decades. Summit County is truly not only Colorado&#8217;s play ground, but is becoming America&#8217;s playground as well. The number of adults aged 65 and over living in Summit County is projected to grow over 250 percent in the next couple decades. Between 2000 and 2010 the population of adults over 65 living in Summit County increased over 100 percent.</p>

<p>It use to be that when people got to retirement age here in the Colorado High Country, they would leave as life was too harsh here. BUT, now that Summit County has a very modern hospital and wonderful grocery stores and factory outlets stores as well as a Wal-Mart and Target, life here in the high country has become must easier.  The county is looking at ways to have more housing available that will meet the needs of the ever increasing senior citizen population. They are also looking into meal services and affordable senior living options. This is an exciting time here in county.</p>

<p>The Shores at Breckenridge is a subdivision that is near a place on the Blue River, that might just be for you. The Shores at Breckenridge are one of the more premier spots to build a mountain home. The Shores at Breckenridge is located just north of Breckenridge, where you can stand on the bank and look across designated open space to the Ten Mile Mountains, Old Baldy, Silverheels peaks and on away forever. From the dam at Dillon Reservoir all the way to Kremmling (something like 38 miles) the Blue is a Gold Medal Stream. The Blue isn&#8217;t a big river, which is part of its charm, and part of its challenge. You can easily wade in most parts of it.</p>

<span id="redesign_default">The state is investigating whether nine Colorado real estate brokerages required title companies to pay up to $1 million each for referrals from their agents.</span>The Colorado Division of Real Estate on Monday sent subpoenas via certified mail to the brokerages, as well as to a California company.</p>
<p>The agents received incentives from their companies in exchange for referring their clients to the title companies that make payments, said Erin Toll, director of the Division of Real Estate.</p>
<p>&#8220;These types of payments to real estate settlement providers are bad for consumers because they artificially inflate the price of title insurance,&#8221; Toll said. &#8220;I believe this is one of the reasons that title insurance rates have not decreased even though title searches are nearly 100 percent electronically performed.&#8221;</p>
<p>Title insurance, which typically costs home sellers between $500 and $1,000, protects lenders and owners against losses from property-ownership disputes.</p>
<p>Toll said the alleged kickback scheme comes under the guise of &#8220;marketing agreements.&#8221;</p>
<p>&#8220;They&#8217;re saying: You can have exclusive rights to all of our work if you pay me money and we call it marketing,&#8221; she said.</p>
<p>In her previous position as the state&#8217;s deputy insurance commissioner, Toll gained national attention when she launched a broad-reaching investigation of kickback arrangements in the title-insurance industry.</p>
<p>&#8220;This is a different form of the same thing,&#8221; Toll said. &#8220;It&#8217;s illegal to give remuneration in any form for referral of business tied to a federally related loan, which most mortgages are. It&#8217;s insidious. It&#8217;s everywhere.&#8221;</p>
<p><strong>Feds also probed referrals</strong></p>
<p>The current investigation comes more than two years after Toll prompted the federal government to mount an aggressive campaign to stamp out illegal referral fees that were in violation of the Real Estate Settlement Procedures Act.</p>
<p>The U.S. Housing and Urban Development Department settled at least a dozen kickback cases in 2005.</p>
<p><strong>Some of the state&#8217;s best-known real estate firms are among those being investigated. They are Re/Max International Inc. in Greenwood Village; Slifer Smith &#038; Frampton in Avon; Fuller Towne &#038; Country Properties in Greenwood Village; Coldwell Banker Residential Brokerage in Denver; Keller Williams Real Estate LLC in Littleton; Keller Williams Executives Realty in Highlands Ranch; Re/Max Properties Inc. in Colorado Springs; McGinnis GMAC Real Estate in Colorado Springs; and Home Real Estate in Centennial. The California company is First American Residential Group Inc., a Santa Ana title insurance company</strong>.</p>
<p>Many of the brokerages said Thursday that they had not received a subpoena.</p>
<p>Heather Parness, broker of record for Fuller, and Brad Smith, owner and employing broker of Home Real Estate, said they do not have marketing agreements with any real estate settlement service providers.</p>
<p><strong>Brokerage: Tight, clean ship </strong></p>
<p>Joe Clement of Re/Max Properties Inc. in Colorado Springs said he has an agreement with Wells Fargo for mortgage business. He leases office space to North American Title and Security Title but said he does not have agreements with either company.</p>
<p>&#8220;We run a tight, clean ship,&#8221; Clement said. &#8220;I like to stay out of jail. It&#8217;s tough enough out there.&#8221;</p>
<p>Julie Bergsten, vice president of Slifer Smith &#038; Frampton, declined to comment.</p>
<p>Shaun White of Re/Max International said the company handles franchising, not real estate transactions.</p>
<p>&#8220;We&#8217;ll have to get our hands on the subpoena and see what we have to say about it,&#8221; he said.</p>
<p>The remaining brokerages did not return phone calls Thursday.</p>
<p>Jerry Spaeth, president of First Integrity Title in Denver, said he has not been asked for money in exchange for business.</p>
<p>&#8220;If it is happening, it would explain a lot of the loyalty we run into,&#8221; he said. &#8220;Generally it&#8217;s hard to get Realtors to switch. They tend to be very loyal, more so than mortgage brokers and mortgage lenders. The title companies in town seem to have a very strong hold on some of the larger real estate brokerages.&#8221;</p>
<p>The Division of Real Estate wants the brokerages to provide the marketing agreements they have with all real estate settlement service providers; agreements where they give something of value to a provider or the provider is giving them something of value; information on how much business was given to a provider; and details on compensation paid.</p>
<p>Since taking over the Division of Real Estate in 2006, Toll also has launched investigations into appraisers inflating the values of conservation easements and mortgage brokers committing mortgage fraud.</p>

The project â€” known as Alpine Lake Lodge â€” calls for construction of a nearly 50-foot-tall mixed-use building on the .99-acre site of Ristorante Al Lago on Lake Dillon Drive. The current design includes 44 one-, two-, and three-bedroom condos on three floors, an underground parking level, and 8,500 street-side square feet of commercial space.</span></p>
<p><span class="body2">Summit County commissioners expressed general distaste for requiring the developers to provide deed restricted units, they agreed some steps should be taken to ensure the residences will not be exclusively luxury second homes.  </span><span class="body2">The design calls for â€œhigher endâ€ finishes for the condos â€” complete with granite counter tops, slate and tile flooring, premium carpet, and natural wood cabinetry. Commissioner </span><span class="body2">Terry Novak said he would like to see </span><span class="body2">a commitment to getting full-time residents in there.</span></p>
<p><span class="body2">Because the siteâ€™s existing â€œcommercialâ€ zoning designation required a higher ratio of commercial to residential square footage and precluded any ground floor residential units, the town council passed an emergency zoning resolution in February to allow the planning process to continue. Even with the emergency accommodation, the owners must still meet the formal requirements for their proposed Planned Unit Development (PUD), as well as for the conditional use permit.</span> <span class="body2">If the approval process continues without a hitch, the developers expect to break ground spring in 2009.</span></p>

<p>The Council is evaluating the possibility of restricting the location of new offices in the downtown commercial area, as a means of ensuring that pedestrian-friendly commercial<br />
uses (such as retail shops and restaurants) are retained.</p>
<p>On Wednesday, February 20 from 5:30 to 7:00 p.m. in the Council Chambers of the Breckenridge Town Hall, the Town is hosting a public open house to share information on a series of options and to gather public comments on these options.  All members of the public are encouraged to stop by and offer their input on this important issue.</p>

<strong>Peak 6-</strong> Plans for a new lift and 450 acres of new terrain are formally on the table. About six trails totaling 67 acres would be clear-cut below timberline. An additional 285 acres including intermediate, advanced-intermediate and expert skiing terrain would be above timberline and lift served. Breckenridge Ski Resort also proposes to construct a top terminal ski patrol and warming hut and a bottom terminal food and beverage facility.</p>
<p><strong>Peak 7</strong>- Construction of the sold-out Crystal Peak Lodge and Grand Lodge continues. The relocation of Ski Hill Road from its present location, down to the new Peak 7 base area is expected to occur this summer. The 17.22 acre ski-in estate site &#8216;Pristine Villaggio&#8217; is available with an asking price of $5.4 million. Based on current pricing at condo developments, one lucky owner could own either 8,000 sq. ft of condo space or &#8216;Pristine Villaggio&#8217; with its 750,000 sq. ft. of land, and construct a 10,000 sq. ft. luxury residence for the same price!</p>
<p><strong>Peak 8</strong>- One Ski Hill Place, a 90 unit development at the base of Peak 8 is the newest luxury offering by Vail Resorts. Prices range from $963 to $1,385 per square foot. Construction is scheduled to begin in May, pending pre-sales, and due for completion for the 2009-2010 ski season.</p>
<p>Shock Hill- The Shock Hill Lodge &#038; Spa, will be located at the midway station of the new BreckConnect Gondola. The most expensive condominium in Breckenridge (pre-sale- under contract) of $3.8 million will have views of Pristine Villaggio and the Breckenridge Ski Resort. The project consists of 100 units being released in six phases.</p>

<p>The Colorado Lottery sold its first Scratch ticket in January 1983. Lotto began in January 1989, and Cash 5 in September 1996. On August 2, 2001, the Colorado Lottery introduced the mega-jackpot game Powerball. Now, more than two decades since the Lottery began, more than $1.7 billion has been returned to the people of Colorado through parks, open space, recreation, wildlife projects and more, not to mention more than $3.4 billion in the way of prizes.</p>
<p>Lottery dollarsâ€”$11.6 million through Great Outdoors Coloradoâ€”are being put to use in preserving parcels like the Red Mountain Ranch north of Fort Collins, in the Laramie Foothills Mountains to Plains Legacy project.</p>

The entire state benefits from funds generated by the Lottery. More than $1.7 billion has been returned to the state for parks, recreation, open space, conservation education and wildlife projects since the Lottery started in1983. In 2005 alone, more than $113.7 million went back to the state.</font></p>
<p><strong><font class="copyTitle">Conservation Trust Fund</font></strong><br />
<font class="copy">Local parks and recreation providers â€“ towns, cities, counties and special districts â€“ receive money from the <a target="new" href="http://www.dola.state.co.us/LGS/FA/ctf.htm">Conservation Trust Fund (CTF)</a> in proportion to their population. More than $45.5 million was distributed through the fund in 2005 for open space and land acquisition, equipment purchases, facility development, park maintenance, and renovation or restoration of local facilities.</font></p>
<p><strong><font class="copyTitle">Colorado Division of Parks and Outdoor Recreation</font></strong><br />
<font class="copy">Coloradoâ€™s 40 state parks use Lottery money for trail construction and maintenance, land acquisition, equipment and facility purchases and maintenance of state parks facilities. More than $11.4 million was distributed directly to <a target="new" href="http://parks.state.co.us/">Colorado Division of Parks and Outdoor Recreation</a> in 2005.</font></p>
<p><strong><font class="copyTitle">Great Outdoors Colorado</font></strong><br />
<font class="copy"><a target="new" href="http://www.goco.org/">Great Outdoors Colorado (GOCO)</a> gives money to projects across the state that impact communities. Funds have built trails, helped open recreation facilities, preserved ranchlands and view corridors, improved and expanded river quality and access, and conserved wildlife habitat.</font></p>
<p><font class="copy"><img id="image471" alt="aspensjpeg.jpeg" src="http://www.summitcountymountainproperty.com/blog/wp-content/uploads/2007/11/aspensjpeg.thumbnail.jpeg" /></font></p>
<p><font class="copy">The Colorado Lottery is GOCOâ€™s only funding source, and gives GOCO 50 percent of proceeds, capped at $35 million in 1992 dollars, and adjusted for inflation. If this percentage exceeds the adjusted $35 million cap, the remainder goes to underfunded public school districts to address facility safety issues. In 2005, the distribution to GOCO was $55.1 million.</font></p>
<p><strong><font class="copyTitle">School Health and Safety</font></strong><br />
<font class="copy">When the Colorado Lottery joined Powerball in1992, the distribution formula changed to include funding for school health and safety issues. Referendum E mandates that GOCO receive 50 percent of Lottery proceeds up to $35 million (in 1992 dollars), with the spillover being used to address health and safety issues in public schools. In 2005, more than $1.7 million was distributed to the public schools.</font></p>

A recent report totaling the sales in five Colorado mountain resort counties, including Summit County real estate sales, touted a combined record of $8.56 billion in real estate sales in 2007.</font></p>

They range from $4.52 million in Pitkin County to an affordable $794,391 in Summit County and $450,240 in the outlying Garfield County. <p>A key component of the plan includes moving the bottom terminal of the new River Run Gondola into the River Run Village, significantly enhancing the guest experience for both River Run destination guests as well as day visitors parking at the River Run Village, by making access to the gondola easier. <span id="redesign_default" /></p>
<p><span id="redesign_default"> Keystone is one of the most visited ski resorts in the country featuring three mountains, five bowls, world-class gladed skiing, a top-rated terrain park and a new snowcat ski tour operation. Additionally, the Colorado resort offers guests one of the largest conference centers in the Rocky Mountain region, two championship golf courses, two on-site hotels, award-winning restaurants and a newly renovated spa at the Keystone Lodge &#038; Spa, a RockResort property.</span></p>

<p><span id="redesign_default">Keystone plans to purchase a state-of-the-art gondola from Doppelmayr that utilizes the latest drive technology and is expected to be 30 to 40 percent more energy efficient than other modern ski chairlifts or gondolas.</span></p>
<p><span id="redesign_default">The new cabins are designed with passenger comfort in mind with floor-to-ceiling windows providing the best possible view and with room to accommodate skis and snowboards inside the cabin. Additionally, the new gondola will offer level walk-in heated load and unload stations to provide convenient access for wheelchairs, mountain bikes, strollers, sight seers, mountaintop tubing hill guests and night-time dining guests.</span></p>
<p><span id="redesign_default" /><br />
<span id="redesign_default">With a vertical rise of 2,307 feet and a top-to-bottom average trip time of less than 12 minutes, the new eight-passenger River Run Gondola will transport about 2,400 people per hour, more than twice the current level. Keystone plans to operate the new River Run Gondola winter and summer.</span></p>
<p>Construction for the gondola is expected to begin April 2008 with a planned opening for the 2008-2009 ski and snowboard season. <span id="redesign_default">    In the second phase of this project, a new skier bridge will be constructed to replace the current pedestrian bridge, which will allow guests to ski directly from the mountain into a newly enhanced skier plaza and skier services area in the River Run Village. The enhanced skier plaza and skier services area and the new skier bridge are slated for completion during the summer of 2009.</span></p>
